Siren.Audio — Copyright & DMCA Policy

Siren.Audio LLC ("Siren.Audio," "Siren," "we," "us," or "our") respects intellectual-property rights and expects users, creators, and publishers to do the same. This Policy explains how to report material you believe infringes copyright, how the person who provided the material may respond, and how we address repeat infringement. It forms part of our Terms of Service and is intended to operate consistently with the notice-and-takedown framework of the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

1. Copyright takedown notices

If you are a copyright owner or are authorized to act for one and believe material on the Service infringes your copyright, send a written notice to our Designated Agent that substantially includes:

1. your physical or electronic signature;

2. identification of the copyrighted work claimed to have been infringed, or a representative list if one notice covers multiple works;

3. identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient for us to locate it, such as the Title name, creator or publisher name, and applicable URL or Service identifier;

4. information reasonably sufficient for us to contact you, such as your name, mailing address, telephone number, and email address;

5. a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

A notice that omits required information may delay our response. If a notice identifies the copyrighted work, the allegedly infringing material, and provides contact information but is otherwise incomplete, we may contact the sender for additional information. Knowingly or materially misrepresenting that material is infringing may expose the sender to liability under applicable law.

2. Our response to a notice

When we receive a notice that substantially complies with the DMCA, we may act expeditiously to remove or disable access to the identified material and make reasonable efforts to notify the person or Seller who provided it. We may request additional information, preserve relevant records, restrict publication, and take other action permitted by our agreements and applicable law.

A takedown does not necessarily resolve ownership or liability between the parties. Separate from the DMCA process, Siren may enforce its Creator & Publisher Agreement when we reasonably determine that a Seller submitted stolen, unauthorized, infringing, or fraudulently represented content.

3. Counter-notices

If you believe material you provided was removed or disabled as a result of mistake or misidentification, you may send our Designated Agent a written counter-notice that substantially includes:

1. your physical or electronic signature;

2. identification of the material that was removed or disabled and the location where it appeared before removal or disabling;

3. a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;

4. your name, address, and telephone number; and

5. a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, the United States District Court for the Northern District of Florida or another judicial district in which Siren may be found, and that you will accept service of process from the person who submitted the original notice or that person's agent.

If we receive an effective counter-notice, we may restore the material not less than 10 and not more than 14 business days after receipt unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity. Restoration remains subject to any independent violation of our agreements or policies.

5. Repeat-infringer policy

Siren maintains a policy of terminating, in appropriate circumstances, users, creators, or publishers who are repeat infringers. We may consider valid takedown notices, court findings, our own reasonable determinations, repeated unauthorized uploads, attempts to evade enforcement, and other relevant facts. We may also restrict or terminate related accounts used to continue the same infringing conduct.

We may disable disputed Titles and temporarily hold Seller payouts while a credible rights complaint is investigated. If we determine that a Seller published or monetized stolen, unauthorized, or infringing content, the Seller is not entitled to payment for revenue attributable to that content, and we may apply the withholding, forfeiture, offset, remittance, and clawback remedies in the Creator & Publisher Agreement.

6. Standard technical measures

To the extent applicable, Siren accommodates and does not intentionally interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as contemplated by 17 U.S.C. § 512.

7. Trademark and other rights

The DMCA process applies to copyright. For trademark, publicity, privacy, contract, impersonation, or other non-copyright complaints, contact support@siren.audio with a description of the issue, the material involved, the basis of your claim, and information sufficient for us to locate the material and contact you.

8. Changes

We may update this Policy prospectively. Material changes will be posted with a new Last updated date and any additional notice required by law.
